Westi Games Terms of Service
These terms are an agreement between you and Westi Games (“we”, “us”), Raoul Wallenberg 2, Rehovot, Israel, about playing our games. Today that is one game, Brawl Cars (“the game”). Where something applies to Brawl Cars only, these terms say so.
You agree to these terms when you tap “Accept & continue” in the game. If you’re under the age of majority where you live, a parent or guardian must read them with you and agree to them for you. Our Privacy Policy explains what the game collects and why.
1. Your licence to play
We give you a personal, non-exclusive permission to install the game on devices you own or control and to play it for your own enjoyment, not for business. You can’t transfer this permission to anyone else.
The game, including its code, art, music, characters and names, belongs to us or to the people we license it from. You have permission to use it, but you don’t own it.
2. How Brawl Cars works
- It needs the internet. You must be online to play.
- Your rivals are computer-controlled. Every rival in a race is a character played by the game, not another person, and the leaderboards are made up by the game, not by other players. There’s no chat or contact between players.
- Races adapt to you. The game chooses each race, and how strong your rivals are, from your recent results and how long you’ve played. New players win more often. After the first few weeks wins come less easily, so upgrading your car matters more. Players returning after a long break get a few easier races.
- Settings can change. We may change rewards, prices, odds and difficulty at any time, including to balance the game, and different players may get different settings at the same time.
3. Coins, gems and other in-game items
- Coins, gems, cards, chests, keys, card packs, cars, Skip Its, levels, leagues and trophies (“in-game items”) exist only in the game. They have no value in money, and you can’t exchange them for money or anything outside the game, or sell, trade or transfer them.
- You have a permission to use the in-game items you get, as part of your licence. You don’t own them.
- Unless the law where you live says otherwise, in-game items aren’t refundable, and they end when your licence ends (section 10).
4. Buying things
- Through the store. You buy through Google Play or the App Store, under the store’s own terms. The store shows the price in your currency, with any taxes, before you pay, and takes the payment.
- Delivered at once. What you buy is added to your game straight away. If the consumer laws of the European Union or the UK apply to you, you have a 14-day right to cancel a purchase of digital content, but you lose it once delivery starts. Before your first purchase, the game asks you to agree to delivery starting at once and to confirm that you know you lose this right.
- Refunds are handled by the store, under its refund policy, and where the law gives you a right to one. If something you paid for didn’t arrive, tap Restore Purchases at the bottom of the shop, or write to us.
- Chests and card packs contain items chosen at random. Before you buy one, the shop shows the chance of getting each kind of item: tap Odds when you buy, or Odds for Chests and Card Packs at the bottom of the shop.
- Parents: purchases use the store account on the phone. The store’s parental controls (Google Play’s purchase approval, or Apple’s Ask to Buy) let you approve every purchase.
5. Memberships and the Race Pass (Brawl Cars)
- VIP and ELITE clubs come as a monthly subscription or as a one-time “lifetime” purchase. The club page in the game lists what each gives, such as no ads between races, double coins earned in play, daily Skip Its and a members-only car.
- Monthly memberships renew automatically each month at the price shown in the store, until you cancel. Cancel in the store’s subscription settings (Google Play ▸ Payments & subscriptions, or the App Store ▸ Subscriptions) at least 24 hours before the renewal date. You keep the benefits until the end of the month you paid for. The game can’t cancel a subscription for you.
- Lifetime memberships last for as long as we offer the game, not for your lifetime or ours (see section 9).
- The premium Race Pass applies to the season you bought it in. Rewards you’ve reached but not claimed when the season ends are kept, and you can claim them afterwards.
- We may change what a membership or the pass includes. If a change takes away something important you’ve paid for, we’ll tell you in the game first, and you can cancel.
6. Your progress and account
Your progress is saved on your phone and backed up to the cloud under an anonymous account, and it’s played on one phone at a time.
- 13 and over: link Google Play Games in Settings ▸ Google Play to keep your progress on a new phone or after reinstalling the game.
- Under 13: your progress stays on your phone. Reinstalling the game, clearing its data or moving to a new phone starts again from the beginning.
- If two copies of your progress disagree, the game asks which one to keep, and the other is lost.
7. Fair play
You agree not to:
- cheat, or use bots, changed versions of the game, or tools that change the game or its save;
- use bugs to get an advantage, instead of reporting them to us;
- copy, reverse-engineer, decompile or change the game, except where the law allows it;
- interfere with the game’s servers or with other players’ data;
- choose a player name that’s offensive, pretends to be someone else, or includes personal information.
Players under 13 get a name from the game and can’t type their own. We may change a name that breaks these rules.
8. Updates
We may update, change or improve the game. You may need to install an update to keep playing.
9. If we stop offering the game
We may stop offering the game, or part of it. If we stop it for good, we’ll tell you in the game at least 30 days before, stop selling items as soon as we tell you, and stop monthly memberships renewing. Where the law gives you a right to a refund for something you paid for and can no longer use, you’ll get one.
10. Ending this agreement
You can end this agreement at any time: delete your data (Settings ▸ Delete My Data) and uninstall the game. Cancel any monthly membership in the store as well.
We may suspend or end your access if you seriously or repeatedly break these terms, or if the law requires it. Unless the problem is urgent or the law prevents it, we’ll tell you why first. When the agreement ends, your licence and your in-game items end too.
11. No guarantees
We work to keep the game running and your progress safe, but as far as the law allows, we provide the game “as is” and don’t promise that it will always be available, free of errors, or that your progress will never be lost. This doesn’t affect the rights you have as a consumer where you live.
12. Limits on our liability
As far as the law allows, we aren’t responsible for losses that weren’t reasonably foreseeable, or for the loss of in-game items or progress except where it’s our fault. The most we have to pay you for any claim is the greater of what you paid us in the 12 months before the claim, or 50 US dollars.
Nothing in these terms limits our responsibility for death or personal injury caused by our negligence, for fraud, or for anything else the law doesn’t allow us to limit, and nothing takes away the rights you have as a consumer where you live.
13. Which law applies
The laws of the State of Israel apply to these terms, and disputes go to the competent courts in Israel. If you are a consumer and live elsewhere, you keep the protection of the laws where you live, and you may also bring a claim in your local courts.
14. Changes to these terms
If we change these terms in a way that matters, the game shows you the new version and asks you to accept it before you carry on. The version number and the date it took effect are at the top of this page.
